Constitution has been divided into Parts, Articles, and Schedules[?]. In this post lets us quickly have a look at some facts of Part I of the Constitution.
Part I of the Constitution is named as the Union and its territories. Contains Articles (1) - (4).
- Article (1) recognizes India, that is Bharat shall be a union of states. States and territories are specified in First Schedule. The term territories comprise of States, UTs and other territories that may be acquired.
- Article(2) gives the power to parliament to admit and establish new states by a simple majority of the member present.
- Article(3) gives the power to parliament to form a new state by combining or breaking old ones, to increase, diminish, alter boundaries, and rename the old states. A bill under this article cannot be introduced in the parliament without the prior permission of the President. The bill has to be referred by the President to the State legislature for expressing its 'views', to which parliament may or may not agree to.
- Article (4) says that the bills under Articles (2) & (3), will not be considered an amendment under Article (368). Laws under (2) & (3) will provide for the amendment of First and Fourth Schedules.
