Constitution - Part IV (Directive Principles) [Article (36)-(51)]

In the previous article, we discussed the Fundamental Rights conferred upon the citizens by Part III of the Constitution. In this post, let's discuss the Directive Principles Of State Policy under Part IV of the Indian Constitution containing 16 Articles from (36) - (51).

  • Article (36) defines the state as same as in Part III
  • Article (37) states that provisions of this part are not enforceable in any court, but state shall apply these principles while making laws.
  • Article (38) directs the state to promote the welfare of the people by securing social order and decrease the social inequalities.
  • Article (39) guides the state to be responsible for maintaining equality among citizens in terms of employment, wealth distribution, and to live a healthy life.
  • Article (39A, state shall secure that the operation of the legal system promotes justice, on a basis of equal opportunity, and provide free legal aid
  • Article (40) directs the states to take steps to organize village panchayats.
  • Article (41) directs the state to ensures the right to work, education and public assistance to certain members of the society like aged, sick people, and disabled   etc.,
  • Article (42) directs the state to ensure the humane working conditions and for maternity leave.
  • Article (43) directs the state to try and secure suitable, decent and satisfying wages to the workers.
  • Article (43A) states that the state shall take suitable steps to secure the participation of the workers in the management of the establishment.
  • Article (44) - State shall try to secure the Uniform Civil Code.
  • Article (45) - State shall try to provide free and compulsory education to all the children below the age of 14 within the 10 years of commencement of this constitution.
  • Article (46) directs the state to promote the educational and economic interests of the weaker sections of the people.
  • Article (47) - state shall raise the level of nutrition and public health of the citizens. The state shall try to prohibit intoxicating drinks unless for the purpose of medical treatments.
  • Article (48) - state shall agriculture and animal husbandry on modern and scientific lines. The state should take steps for the prohibiting slaughter of cows and other milch and draught cattle.
  • Article (48A) - State shall take steps to protect the environment, forests, and wildlife of the country.
  • Article (49) make the state responsible for the protection of ancient monuments and other historically and culturally important structures and places.
  • Article (50) directs the state to take steps to separate the judiciary from the executive in the public services.
  • Article (51) - State shall endeavor to promote international peace and security, to maintain just and honorable relations between nations, foster respect for international law and treaty obligations in the dealings of organized people with one another and encourage settlement of International disputes by arbitration.
