Constitution - Part II (Citizenship) [Article (5)-(11)]

In the previous post, we've seen some qacts about Constitution - Part I. In this post lets learn some quick facts about Part II of the Constitution, titled "Citizenship".

Part II of the Constitution consists of seven articles from Article (5) to (11).
  • Article (5) recognizes every person who has a domicile in India during the enactment of the constitution as a citizen of India, this includes a person born in India or either of the parents born in India or ordinary resident of India for not less than 5 years.
  • Article (6) recognizes at person migrated from present-day Pakistan as a citizen if his parents are citizens of India under the Government of India Act 1935 and migrated before 19 July 1948. If a person has migrated after 19 July 1948, then he has to be resident of India for at least 6 months to acquire the citizenship.
  • Article (7) does not recognize the person migrating to Pakistan after 1 March 1947 as an Indian citizen.
  • Article (8) states that a person residing out of the territory of India can register himself as a citizen at the diplomatic or consular representative if his ancestors belong to India.
  • Article (9) states that a person cannot be a citizen of India under (5),(6) & (8) if he voluntarily acquires citizenship of a foreign state.
  • Article (10) directs that every citizen is subject to the laws made by the parliament to be such citizen.
  • Article (8) gives powers to the parliament to regulate the rights of citizenship by law.
